The Ombudsman’s Office monitors the judicial proceedings in connection with the death of A.Tarba.

The Ombudsman’s office of RA keeps attending court hearings of former staff members of the Ministry of Internal Affairs of the RA. Namely, the head of the MIA, Police Colonel Dzhikirba B. V. and the Deputy, Lieutenant Colonel Chediya A.V., accused of committing a crime under Part 3 of Article 295 and Part 1 of Article 295 of the RA Criminal Code, as well as Head of the Property Crimes Unit Major A.B. Outlev and senior security officer of the same department, captain Kulov V. M, accused under paragraphs "a", "b", "c", Part 3 of Article 288 and Part 4 of Article 105 of the RA Criminal Code. The listed officials are being accused of negligence, abuse of power, physical violence against Tarba A.V., resulting in his death on the night of July 10-11, 2019 in the building of the MIA of RA.

Considering that the crime was committed in the building of the RA Ministry of Internal Affairs and that the suspects are senior officials, we hope that all the facts of lawlessness and arbitrariness for this case will be brought to light during the trial.

Given the danger of such a precedent as torture, which undermines the foundations of the law enforcement system, we consider it necessary to carry out exhaustive and impartial investigations of the events that took place in the building of the Ministry of Internal Affairs, so that perpetrators do not escape justice. It is necessary to investigate the actions and the degree of guilt of each MIA employee who was involved in this crime.

“No State may permit or tolerate torture or other cruel, inhuman or degrading treatment or punishment.” (Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment).

“Those who encourage, order, tolerate or perpetrate acts of torture must be held responsible and severely punished, including the officials in charge of the place of detention where the prohibited act is found to have taken place...” (Resolution 55/88 adopted by UN General Assembly).
